Sabah groups list 6-point action plan to tackle illegal immigrant problem


With no action forthcoming on foreigners with illegal citizenship in Sabah even after the release of an inquiry commission report, a group of political parties and non-governmental organisations in the state have put up a list of demands for the authorities to fulfil next year.



Among the demands is for a thorough clean up by the Election Commission of the state's electoral roll to weed out unqualified "voters", the group, made up of 21 non-governmental organisations and three political parties, said.



The parties are the Sabah State Reform Party (STAR), Sabah Progressive Party (SAPP) and Parti Cinta Sabah (PCS).



They and the NGOs also want to be given access to monitor the purging of the electoral roll from voters who were issued citizenships fraudulently.



In their six-point demand, they also want the authorities to scrutinise dubious MyKad given to unqualified foreigners and want a massive recall and reissuance of the special Sabah identity cards to all Sabahans and "genuine Malaysians" with permanent residence in Sabah.



They said this could be done by setting up a Sabah registration department under a new Sabah Registration Ordinance.



Additionally, they want the authorities to investigate and prosecute those who have been implicated in the report by the Royal Commission of Inquiry (RCI), which was tasked with studying the problem of illegal immigrants in Sabah and the alleged "Project IC" which saw the granting of citizenships to foreigners.



The findings of the RCI report, which was released early this month after a six-month delay, found that syndicates and those with help from corrupt officials had set up "Project IC" in the Bornean state for a "political agenda and money".



However, the report was silent on those whose actions altered the state's demographics and religious balance.



"The federal government should make available to the public all records of proceedings of the RCI and the exhibits, memorandum and submissions by witnesses.



"A special session in Parliament and the Sabah assembly should be convened to debate on the findings and recommendations of the report," the group said at a press conference today.



STAR chairman Datuk Dr Jeffrey Kitingan said a request for an emergency session to debate the RCI findings had been submitted to the legislative assembly.



He will also lead a monitoring and action committee to ensure the six-point demands are met by Putrajaya.



"We want the federal government to take immediate action, or else the unhappiness among Sabah people will worsen."



Failing which, SAPP president Datuk Seri Yong Teck Lee said the group would consider peaceful protests and bringing the matter to international level if the lack of inaction persisted.



The RCI report, which was released in Kota Kinabalu earlier this month, revealed that 67,675 illegal immigrants were given blue or citizen identity cards and another 68,703 given outright citizenship.



The RCI was formed on August 11, 2012 to investigate the problems related to citizenship and immigrants in Sabah.



The inquiry was closely related to “Project IC”, the alleged systematic granting of citizenship to foreigners.



Public hearings began in Kota Kinabalu on January 14 last year by a five-member panel led by former Chief Judge of Sabah and Sarawak, Tan Sri Steve Shim Lip Kiong.



The hearing ended on September 20, 2013, but the delay in making the report public led to speculations of a cover up and that important information from the report had been suppressed.



There was further disappointment when the panel's report failed to put forth any clear solution, other than to recommend the forming of a permanent committee and a management committee to handle issues related to illegal immigrants in the state.



A total of 211 witnesses were called to testify, among them former prime minister Tun Dr Mahathir Mohamad, opposition leader Datuk Seri Anwar Ibrahim, former Sabah chief minister Tan Sri Harris Salleh, former Sabah chief minister Datuk Seri Yong Teck Lee, former senator Dr Chong Eng Leong and Kitingan himself, a former Internal Security Act detainee. – December 30, 2014.

KUALA LUMPUR: Menteri Dalam Negeri Datuk Seri Ahmad Zahid Hamidi harus berhenti dari terus ‘mengaburkan’ Laporan Suruhanjaya Siasatan Diraja (RCI) Sabah yang sudah memang sedia kabur kata Ketua Parlimen DAP Lim Kit Siang.



Katanya, penafian Zahid tidak membawa sebarang makna kerana Laporan RCI Sabah itu sendiri menyebut kewujudan Projek IC kerajaan.



“Penafian kewujudan Projek IC ini sama sekali menolak laporan itu yang menyatakan bahawa ‘kemungkinan wujudnya projek IC’.



Tegas Kit Siang kesimpulan dan jawapan RCI Sabah sama ada wujud atau tidak, ia tertera di halaman 300 laporan tersebut.



“Secara ringkas, terdapat kebarangkalian wujudnya projek itu setiap masa,” kenyataan Laporan RCI Sabah pada muka surat 300 dipetik.



Ujar Kit Siang, penafian Zahid bukan perkara baru kerana sebelum ini Ketua Setiausaha Negara Datuk Seri Ali Hamsa dan Peguam Negara Tan Sri Abdul Gani Patail turut memainkan peranan sama.



“Ali mendakwa kerajaan tidak terlibat dalam Projek IC dan Gani mengatakan nama-nama yang meragukan dalam daftar pemilih telah dibuang.



“Mungkin ini juga puncanya mengapa Ahli Parlimen Kota Kinabalu Jimmy Wong , Adun Kepayan Dr Edwin Bosi dan beberapa wakil NGO dihalang menghadiri majlis pengumuman Laporan RCI Sabah 3 Disember lalu,” tegasnya.



Ahli Parlimen Gelang Patah itu turut menyeru Pengerusi Jawatankuasa Kerja Laporan RCI Sabah Tan Seri Joseph Pairin Kitingan supaya memberi penjelasan berhubung 5,000 muka surat yang hilang dari laporan terbabit.

Mahkamah Rayuan tersalah arah apabila mengekalkan sabitan bekas Menteri Besar Selangor Dr Mohamad Khir Toyo bagi pertuduhan memperoleh barangan berharga iaitu dua bidang tanah dan satu unit banglo untuk diri sendiri dan isterinya, Mahkamah Persekutuan diberitahu hari ini.



Peguam Tan Sri Muhammad Shafee Abdullah, mewakili Dr Mohamad Khir, berkata ini kerana pertuduhan itu ada kecacatan.



Beliau berkata ini kerana pertuduhan itu menyatakan Dr Mohamad Khir melakukan kesalahan itu atas kapasiti rasminya sebagai menteri besar Selangor, manakala Mahkamah Rayuan mengekalkan sabitan Dr Mohamad Khir atas kapasitinya sebagai pengerusi Perbadanan Kemajuan Negeri Selangor (PKNS).





"Pihak pendakwa raya tidak meminda pertuduhan itu sehingga hari ini. Kami dipandu oleh pertuduhan itu. Pertuduhan terhadap perayu (Dr Mohamad Khir) ada kecacatan," kata Muhammad Shafee pada pendengaran rayuan terakhir Dr Mohamad Khir untuk membatalkan sabitan dan hukuman penjara 12 bulan.



Hakim Besar Malaya Tan Sri Zulkefli Ahmad Makinudin mempengerusikan pendengaran rayuan itu bersama-sama empat hakim Mahkamah Persekutuan iaitu Tan Sri Ahmad Maarop, Tan Sri Hasan Lah, Tan Sri Jeffrey Tan Kok Wha dan Datuk Ramly Ali.



Muhammad Shafee berkata anak guamnya dituduh mengikut Seksyen 165 Kanun Keseksaan, yang terpakai bagi kakitangan awam dan hujahnya Dr Mohamad Khir, adalah menteri besar dan anggota lembaga dan pengerusi PKNS pada masa itu, tidak termasuk di bawah definisi kakitangan awam.



Beliau berhujah perkara utama dalam kes pihak pendakwaan ialah Dr Mohamad Khir membeli satu hartanah pada harga tidak wajar RM3.5 juta pada 2007 dan menegaskan pihak pendakwaan berhujah tidak relevan untuk bergantung pada nilai pasaran.



Bagaimanapun, katanya, pihak pendakwaan bergantung pada laporan penilaian oleh Trans Asia Properties, yang dilantik oleh saksi kedua pihak pendakwaan, Shamsuddin Hayroni, yang merupakan pengarah Ditamas Sdn Bhd, dan pada masa sama mengabaikan sepenuhnya laporan penilaian dibuat Rahim & Co, penilai yang dilantik oleh sebuah bank.



Penilaian Rahim & Co terhadap hartanah itu pada harga RM3.5 juta, selepas melakukan pemeriksaan terhadap keadaan sebenar hartanah itu pada 2007, langsung tidak dicabar oleh pihak pendakwaan, katanya.



Beliau juga berhujah Mahkamah Tinggi dan Mahkamah Rayuan langsung tidak mempertimbangkan pertukaran barangan bernilai atas hartanah itu pada 2004 dan 2007.



Pada 2004, terdapat bangunan dengan reka bentuk Itali berserta sijil layak menduduki manakala pada 2007, hanya tinggal struktur bangunan itu tanpa sijil layak menduduki, katanya.



Pada 23 Disember, 2011, Mahkamah Tinggi di Shah Alam mendapati Dr Mohamad Khir, 49, bersalah terhadap pertuduhan memperoleh untuk diri sendiri dan isterinya Zahrah Kechik, 47, dua bidang tanah dan sebuah banglo di Seksyen 7, Shah Alam, dan menjatuhkan hukuman penjara 12 bulan terhadapnya.



Hartanah itu diperoleh empat tahun lepas daripada Shamsuddin.



Dr Mohamad Khir dituduh melakukan kesalahan itu di kediaman rasmi Menteri Besar Selangor di Jalan Permata 7/1, Seksyen 7, Shah Alam, pada 29 Mei 2007.



Mahkamah Tinggi juga memerintahkan hartanah berkenaan dirampas dan diserahkan kepada kerajaan.



Pada 30 Mei tahun lepas, Mahkamah Rayuan menolak rayuan itu dan mengekalkan keputusan Mahkamah Tinggi. Dr Mohamad Khir kemudiannya memfailkan rayuan ke Mahkamah Persekutuan,

IC palsu di Sabah terus jadi persoalan?


Kartel penghasilan kad pengenalan palsu secara tersusun atau berstruktur tidak lagi wujud di Sabah, kata Menteri Dalam Negeri Datuk Seri Dr Ahmad Zahid Hamidi.



Beliau berkata kegiatan kartel yang mungkin wujud dahulu itu, dapat dibanteras hasil tindakan proaktif dan naziran ketat yang dilaksana kementerian dan Jabatan Pendaftaran Negara (JPN).



Bagaimanapun, katanya, orang ramai diminta memaklumkan kepada kementerian sekiranya mempunyai maklumat kegiatan kartel sedemikian masih wujud serta individu yang menjalankan kegiatan tersebut.



"Jika masih ada individu yang terlibat, kami mahu orang ramai memaklumkan kepada kementerian atau JPN untuk tindakan pemantauan dan perundangan dapat segera dilakukan," katanya kepada pemberita selepas merasmikan Hari Inovasi

peringkat kementeriannya di Putrajaya hari ini.



Ahmad Zahid berkata demikian ketika diminta mengulas mengenai laporan Suruhanjaya Siasatan Diraja (RCI) mengenai pendatang asing tanpa izin (PATI) berhubung 'projek IC' yang dibentang Rabu lepas.



Laporan RCI itu mendapati pengeluaran kad pengenalan (IC) biru secara haram kepada pendatang asing di Sabah adalah didorong faktor kewangan.



Ketua Setiausaha Negara Tan Sri Dr Ali Hamsa ketika membentangkan laporan RCI itu berkata tidak ada dalam hasil siasatan suruhanjaya itu menunjukkan pengeluaran IC kepada pendatang asing dibuat atas kepentingan politik, khususnya

atas nama 'Projek IC'.



Ahmad Zahid dalam pada itu berkata susulan laporan RCI itu, kementeriannya akan mengambil tindakan dengan melakukan naziran terhadap jabatan yang terlibat dengan RCI iaitu JPN dan Jabatan Imigresen khususnya di Sabah, supaya permasalahan dalaman yang dahulunya berlaku, tidak berulang.



Selain itu, katanya pemegang kad pengenalan hijau akan dinilai berdasarkan prosedur operasi standard (SOP) bagi menentukan kedudukan mereka berdasarkan kepada syor yang akan diteliti jawatankuasa tetap RCI yang dipengerusikan oleh beliau bersama Ketua Menteri Sabah Datuk Seri Musa Aman.



RCI dalam laporannya turut mengesyorkan sebuah jawatankuasa tetap mengenai PATI ditubuhkan yang akan melaporkan kepada jemaah menteri Kabinet yang dipengerusikan perdana menteri.



Pada masa sama, sebuah jawatankuasa kerja dipengerusikan Timbalan Ketua Menteri Sabah Tan Sri Joseph Pairin Kitingan juga akan ditubuhkan.



RCI ditubuhkan pada 11 Ogos 2012 antara lain diberi kuasa menyiasat jumlah pendatang asing di Sabah yang telah diberi kad pengenalan atau kewarganegaraan.



Mengulas mengenai usaha penambahbaikan yang dilaksanakan JPN, Ahmad Zahid berkata JPN tidak lagi mengeluarkan sijil kelahiran kepada kanak-kanak yang tiada kerakyatan, khususnya di Sabah.



Sebaliknya, menurut beliau, JPN hanya memberi dokumen rekod kelahiran dengan menggunakan warna sijil yang berbeza.



"Ciri-ciri keselamatan MyKad juga ditingkatkan. JPN juga menjalankan pemantauan serta siasatan yang dibuat oleh pegawai penguatkuasaan berpakaian biasa bukan pakaian seragam," katanya.

Corrupt officials, syndicates blamed for alleged 'Project IC'


KOTA KINABALU - Syndicates and individuals aided by corrupt officials spun a web to create a so-called "Project IC" in Sabah with a purported corrosive political agenda for monetary gains.





This was among various issues highlighted in a 368-page report by the Royal Commission of Inquiry (RCI) on immigrants in Sabah made public Wednesday.







The report, however, did not name any perpetrators or guilty parties as this was not within the commission's scope of duties, as stated in the terms of reference (TOR).



The report, which was made public at 4.30pm following a town hall meeting in Kota Kinabalu, summarises the testimonies of key figures among the 211 witnesses who appeared before the commission's five-member panel, headed by former Borneo Chief Judge Tan Sri Steve Shim.







The hearing was held between Jan 14 and Sept 23 last year, where extensive evidence was gathered on the status of immigrants in Sabah, and the standard operating procedures in the issuance of blue ICs or citizenship.







Among the key witnesses were former prime minister Tun Dr Mahathir Mohamad, Opposition leader Datuk Seri Anwar Ibrahim, former Umno minister Tan Sri Aziz Shamsuddin, ex-Sabah chief ministers, as well as former National Registration Department and Immigration department directors.







The witnesses also included politicians, civil servants, academicians and Filipino, Indonesian, Pakistani and Indian immigrants.







But none admitted to any wrongdoing or was there any prove of the existence of a Project IC although several of them admitted that ICs were issued fraudulently by "syndicates and individuals aided by or in complicity with corrupt officials" taking advantage of a weak system.







The second part of the report summarises the evidence and sheds light on how the influx of foreigners under the Project IC had become a burden to Sabah, with the state's population increasing by nearly four-fold in the last four decades.







It also notes several solutions to the immigrant problem, focusing on three main proposals forwarded by witnesses during the course of the inquiry.







In a one-page recommendation, the RCI highlighted the need for strong political will from the Federal and state governments to curb the illegal immigrants problem, suggesting that a Permanent Secretariat be established.







To that effect, the Prime Minister Datuk Seri Najib Razak announced last month that a special panel headed by Sabah deputy chief minister Tan Sri Joseph Pairin Kitingan would study the RCI's recommendations.







The RCI on illegal immigrants in Sabah was first announced by Najib in June 2012.







Its members were appointed in August 2012, and the commission's terms of reference were set by the Attorney-General's Chambers.

oran RCI 'Projek IC' pada Rabu


Laporan suruhanjaya siasatan diraja (RCI) berhubung pendatang haram Sabah yang dinanti-nantikan akhirnya dilapor akan dikeluarkan di Kota Kinabalu pada Rabu.



Ketua Setiausaha Negara Tan Sri Ali Hamsa (kiri) berkata laporan itu akan diumumkan dalam sebuah acara bersama media di Kompleks Tabung Haji di negeri itu, lapor The Star.



Perdana menteri sebelum ini mengumumkan bahawa laporan itu akan diumumkan pada awal Disember, walaupun terdapat desakan supaya ia dikeluarkan semasa sidang parlimen baru-baru ini.



Maklumat berhubung pengeluaran laporan itu didedahkan oleh pemberitahuan Kementerian Penerangan pada Isnin, menurut laporan itu.



Cadangan oleh laporan itu akan dikaji oleh panel diketuai oleh Timbalan Ketua Menteri Sabah Joseph Tan Sri Pairin Kitingan. -mk
