The incident that changed Sabah

Rebel priest, Benjamin Basintal, who stood up for social

justice once blogged: 'Let us fix a collapsing Malaysia

once and for all and let's begin now.'

KOTA KINABALU: Benjamin Basintal died last month. Few will remember that name unless they happened to live in Sabah in 1990.

It was perhaps typical that the daily newspapers with their jingoisms and fawning, sloppy journalism ignored the death of the former Catholic priest-turned-teacher from organ failure at the age of 59.

A bit odd because Benjamin, then a young priest, was the man at the centre of a curious event that was credited and blamed, depending on which side you are on, for the near landslide victory of the opposition Parti Bersatu Sabah government in the 1990 elections.

This was before the state was perversely opened to hundreds of thousands of immigrants, especially Muslims, who were swiftly granted citizenship in an alleged scheme to re-engineer the Christian-majority state into the Muslim one which it has since become.

On July 16, 1990, a feisty local tabloid, Borneo Mail, published an intriguing report on its front page immortally titled: ‘Priest missing – linked to secession plot?’. It appeared on the morning of the state election.

The paper, quoting reliable sources, reported that the priest was believed to have been detained under the ISA in connection with a plot to take Sabah out of Malaysia. It also reported that several other priests were being sought by police for questioning.

Syed Othman Syed Ali, the state police chief at the time, immediately ordered an investigation of the Borneo Mail and its journalists under both the Internal Security Act and the Printing Presses and Publications Act for the “inflammatory” nature of the report.

The article was written by then Borneo Mail chief editor Pung Chen Choon. He became the first journalist in the country to be charged under the Printing Presses and Publications Act which carries a penalty of three years jail or a fine of RM20,000 or both.

The case was heard in court over the following two years with several high-profile witnesses called and widely reported by both the local and national media. But then another strange thing happened; it fizzled out and was quietly shelved as though the outcome was too frightening to pursue.

Pung was defended by Chong Kah Kiat who went on to become Sabah chief minister. Chong was assisted by lawyers Richard Barnes, who is now linked to out-going Sabah Chief Minister Musa Aman, and Gerard Math Lee Min. Current Attorney-General of Malaysia Abdul Gani Patail, then a Senior Federal Counsel, led the prosecution.

KL was paranoid

Some argue that while the Borneo Mail report was speculative it was not far from the truth. Many say that federal authorities were in a heightened state of paranoia about a plot to take Sabah out of Malaysia as they are aware that there has always been nationalistic undercurrents in the state in respect to the peninsula.

Benjamin’s family have always maintained that the former priest was indeed hounded and was being sought by the police along with others he associated with. Church authorities later acknowledged he had been forewarned to “go on leave”.

His elder brother Francis said in a recent interview that his brother was known to campaign for justice for the poor and forgotten and this had put him at odds with the authorities.

But what was he to do? He was a priest and he saw many of them (his parishioners) living in hardship and in distressing circumstance in kampungs in the interior of Sabah.

“Many of his parishioners and the people in the kampungs used to warn him that there were certain men in shiny black shoes asking questions about him.

“They were protective of him and told him not to drive his old and battered vehicle as it was well known to the men who came in Proton Iswara’s with Wilayah (peninsula) number plates.

“These people were going in and out of the kampungs and town in Membakut and Kg Bawan, chit chatting with the people and asking about my brother,” said Francis.

How he was allowed to leave Sabah without the authorities knowing, remains a mystery. According to his brother, Benjamin caught a flight to Kuala Lumpur from the Kota Kinabalu International Airport and from there made his way to the United States after being told to take leave by his superiors in the church.

This was a period, it must be remembered, when Sabahans were defiant and proud about their independence and would denounce Malayan politicians as greedy and domineering. They were confident of their harmony and unity and ability to see off any challenge hurled at them.

The report in the Borneo Mail that Benjamin had gone missing relegated the Barisan Nasional to a footnote in the election and the Christian-dominated PBS emerged victorious much to the fury of then PBS-hating prime minister Dr Mahathir Mohamad and his Umno-led BN coalition government in Kuala Lumpur.

Rare victory

Mahathir had himself only just survived a bitter political battle during the nasty campaign period against his former colleague Tengku Razaleigh Hamzah and his Semangat 46 faction of Umno.

Though unsurprising, the slap-down delivered by voters in the state resulted in Mahathir unleashing a series of outrageous, ham-fisted measures that eventually brought Sabahans to their knees and toppled the PBS state government four years later.

But Benjamin’s fight for justice for his people was a rare victory for the opposition in a time known as Mahathir’s era. The people of Sabah along with those in Kelantan had shown that they were unafraid to say “enough” and “no” to bad governance and misrule.

Benjamin, a young man then, influenced by liberation theology and eager to promote equality along with other reform-minded individuals, encouraged his parishioners and others to question both state and national leaders and what they were delivering.

He was then the rector of a church in Beaufort, a quiet provincial town about 90 kilometres south of here. He was not reticent about speaking his mind, much to the discomfort of his superiors in the Catholic church as well as politicians who sought him out.

He continued to speak his mind after he returned from the US with a degree in journalism and political science. He left the priesthood shortly after and devoted himself to teaching till his death on March 3.

In the 2008 general election he stood as an independent candidate against the Barisan Nasional’s Anifah Aman in Kimanis after he saw that the younger brother of the chief minister Musa Aman was ineffectual in improving the quality of life of the people in his constituency. As expected, he lost, polling just 205 votes but still left his mark.

“Anifah was scared of his outspokenness. He felt threatened by Benjamin’s knowledge and grasp of issues. My brother would tell me he had been approached and told by people close to Anifah not to write or say such things,” said Francis.

In several musings made both in the newspapers and in blog postings Benjamin made in 2008, he spoke of the divisiveness and greed within his own community.

The majority of Kadazans, Dusuns, Muruts and Rungus (KDRM), he lamented in one posting, don’t feel they are united as one community. “Brother (is) fighting against brother. They see people who are greedy for positions to a point where they have to fight their own fellow brothers to get the social status and positions. ”

Pairin ‘motivated by greed’

He was also unabashed about criticising the community’s revered Huguan Siou Joseph Pairin Kitingan who he charged was not capable of leading anybody as he was “motivated by greed and positions … instead of being an agent and force of unity of the KDMR he is a destroyer of that unity and force”.

Benjamin urged his parishioners to free themselves and not be mere followers, saying: “Ducks are wonderful birds but I prefer the eagle as a symbol. Ducks are guided by sounds and influenced by immediate noises and tend to be followers most of the time. Be like the eagle. Be independent-minded, fly high and determine your own destiny.”

“If our actions do not promote justice and if we are not involved in changing the unjust system of society our work will be destitute of positive effects, that is, they are in vain and useless.

“This is the age of participation and the highest level of participation in transforming society is that of the promotion of social justice wherein the poor and oppressed are genuinely liberated from the cycle of economic and social poverty.”

The way Benjamin saw it, Sabah with its abundant natural resources on one side and many of its people abjectly poor on the other side was a gapping wound. The state’s wealth that could help lift them out of the poverty trap was instead paying for vanity projects elsewhere in Malaysia and this was an affront to him.

“Let us fix a collapsing Malaysia once and for all and let’s begin now,” he once said in a blog posting.

The first time Benjamin disappeared, he influenced an election. His passing may do just that again if only people pause to remember what he stood for – social justice!

There is need to increase Christian reps, says Kanul

Kanul Gindol, contesting in Kota Belud parliamentary

under BEBAS platform with a key as it symbol.

By Ezra Haganez

KOTA BELUD : There is a need to increase the number of Christian parliamentarians as the group was currently under-represented, claimed an independent candidate for the Kota Belud parliamentary seat here.

Kanul Gindol, 47, said there could well be less than 10 percent Christian MPs in Malaysia's Parliament, thus this had helped put Christians here vulnerable to exploitations and bullying by the larger blocks.

"A huge majority of the total 222 parliamentary seats in Parliament are already occupied by Muslim MPs as well as the Chinese leaders.

We have no qualm about them winning, but we must seek to increase Christian representation at the House if we are to be heard and respected," he said at his dialogue with community leaders in Kampung Gaur near here yesterday.

Kanul who uses a "key" as his symbol for this May 5 poll, is the sole Christian candidate for Kota Belud parliamentary seat.

He is facing four other aspirants -- incumbent Abdul Rahman Dahlan of UMNO, PKR's Inaraisah Munirah Majilis, Jalumin Bayogoh of STAR and another independent candidate, Lamsil Hamidsor, who has since been "expelled" from UMNO for going against the BN candidate.

According to Kanul, a journalist cum political activist, the under-represented Christian community, had been subjected to loads of marginalisation and ridicule by the establishment and that certain parties from Peninsular simply took them for granted because of their weak number in Parliament.

"So bad was the bullying of the Christians now that an MP had last year even gone overboard calling muslims to burn Christian publications including our Holy Bible or Alkitab. This MP is now rewarded when UMNO withdrew its candidate to pave for his return to Parliament.

"This is unacceptable, particularly because the MP concerned was known to be close, either previously or now, openly or in secret, to both leaders of the ruling Barisan Nasional and opposition Pakatan Rakyat," he claimed.

Kanul, who heads a UK-based NGO, Borneo Rights International ( BRI ), said political parties especially those who claimed to be fighting for minority groups should be mindful of the fact that Christians are already under-represented, and the situation should not be made worse.

"I cannot keep silent when we are taken for granted... Malaysia however is a democratic country and anybody could stand for election, and here today i am seeking to be elected as your representative in Parliament," he told the community leaders.

DAP cabar UMNO/BN nyatakan pendirian mengenai hudud

Roketkini.com

KUCHING: : Calon DAP Parlimen Gelang Patah, Lim Kit Siang mengulangi pendirian DAP mengenai pelaksanaan hudud iaitu tetap berpegang kepada Perlembagaan Persekutuan.

.

Najib’s Sabah visit stirs Musa speculation

Speculations are rife that Chief Minister Musa Aman’s days

are numbered and that Putrajaya may move him out as part

of its ‘transformation’ programme

KOTA KINABALU: Caretaker Prime Minister Najib Tun Razak arrives here today on a campaign stop to push the ruling Barisan Nasional’s message in one of the key states his coalition must win to ensure he is not toppled from power.

Najib will first fly to Kuala Penyu and then Papar on the west coast of the state where a surging opposition has made Umno jittery in both the state and parliamentary seats.

There are three parliamentary constituencies – Beaufort, Kimanis and Papar – up for grabs here and Umno is facing a tough fight in all. The state seats in the immediate vicinity are Kawang, Pantai Manis, Bongawan, Membakut , Klias and Kuala Penyu.

Najib is expected to fly to Keningau and Tenom the following day to shore up support for the BN.

This has set tongues wagging as the east coast of the state, where a security alert is in place after an incursion by a group of armed Filipinos punched a hole in a state the BN calls its “fixed deposit”, is not on his schedule.

Najib’s itinerary also does nothing to silence the question on everyone’s lips about caretaker Chief Minister Musa Aman’s future and if his days in the top post are numbered.

With both the Malacca and Johor chief ministers moved, it isn’t beyond Putrajaya to include Musa in its transformation programme, sources said.

Musa has served as chief minister for more than nine years now and his critics both in and outside the state administration feel Sabah needs a breath of fresh air just like the other states.

His relationship with Shafie Apdal, one of the three vice-president of Umno and the incumbent MP for Semporna, has not been good.

He has also had uneasy ties with others in Umno as well as some BN parties, notably LDP (Liberal Democratic Party).

Salleh as CM?

Will Salleh return as CM of Sabah?

Former Umno strongman, Lajim Ukin, whom Sabah Umno is so worried now that he is in the opposition, blames Musa for forcing him out of the party.

Prior to the dissolution of Parliament earlier this month, there had been talk that Shafie could contest for a state seat which would pave the way for him to take over the chief minister’s post.

But that did not happen.

The return of Salleh Said Keruak, the Sabah Umno liaison deputy chairman, as the party’s candidate for the Usukan state seat has also added fuel to the rumours that he could be in line for another stint at the top.

With a number of senior Sabah Umno politicians qualified for and perhaps eyeing his post, it’s bound to make any chief minister nervous.

Though it is early days yet in the campaign period and it’s anyone’s guess how it will swing, election watchers say Putrajaya could spring a surprise by opting for a new face altogether if the BN wins – someone who will be able to unite the factions in Sabah Umno.

Salleh has already served as chief minister during the state’s quirky chief ministers-on-rotation programme from December 1994 to May 1996 when he handed over the baton to Yong Teck Lee.

A new man or perhaps woman at the helm would work to Najib’s advantage in case he is challenged in the Umno elections.

Others have, however, brushed aside such talk as daydreaming as most of those in Sabah Umno and in the BN component parties are already aligned to Musa.

If push comes to shove in Umno politics, Musa also has some clout at the national level as he maintains a cordial relationship with the various Umno factions there.

Rumours of shake-up

An election observer said that those spreading the rumour of a shake-up in the Sabah government should the BN win may be hoping to dent the performance of the coalition under Musa, who is hoping to do as well or better than the last election when it lost only one parliamentary and one state seat to DAP.

There has been a lot of talk that people aligned to the BN have sponsored candidates to add to the already crowded field of multi-cornered contests with the Pakatan Rakyat opposition front, SAPP, STAR and independents.

So far in the campaign the issue of who will be chief minister has not cropped although there are whispers that someone other than Musa could be in the running, especially if the BN does not win the state with the same convincing margin it did in 2008.

It may be too early to read anything into Najib’s visit to the west coast and the interior today and tomorrow as he has a long haul ahead traversing the country with campaign just begun.

He may come back and visit the east coast where Musa is contesting in Sibuga and Shafie in Semporna perhaps next week.

PRESS RELEASE

“ILLEGITIMATE GOVERNMENT MUST RESIGN” - Dr. Jeff

“The purpose of this Press Conference is to send out an urgent SOS to all Sabahans regardless of race, religion and ethnicity to stand united and save Sabah, “SELAMATKAN SABAH TANAH AIRKU” in the light of the shocking but not unexpected revelations at the on-going RCI hearing so far” said Datuk Dr. Jeffrey Kitingan, Chairman of STAR SABAH at a press conference held today.

No government in the world that is patriotic and loves its citizens would do what Umno and the BN government has done to Sabah. It is high treason of the highest degree and in past history, many would

have been beheaded or hanged for lesser treason offences.

From the RCI disclosures, we can see that we have been governed by leaders that would not have been elected had not illegitimate voters have been inserted and allowed to vote. The present Umno/BN government is illegitimate and should not be allowed to continue and be replaced by a non-partisan caretaker government.

Whilst we cannot change what has happened and leave it to the powers that be to untangle the mess that Sabah is in and punish the culprits and their mastermind, we, all Sabahans, can all make a difference and determine our own future and our own destiny.

We cannot leave it to the Sabah leaders alone, especially those in the Umno/BN government, to save Sabah from further damage and further control by foreigners and from decision-making of our future.

Do you think the leaders of PBS, UPKO, LDP and the like will leave BN and stand on the side of Sabah and ordinary Sabahans? Your guess is as good as mine.

They do not care for the future of Sabah, they do not care for our future and the future of our children and their children. By this, we mean all Sabahans including immigrants who become Sabahans legitimately and who are entitled to be Sabahans and Malaysians.

Even if these leaders care, they cannot do anything about it as they are tied down in BN and more so when many of them have files and dossiers on them. At best, they will leave it to Umno, big brother in BN. We cannot expect thieves to catch thieves.

The general election is just round the corner. If we leave everything to the RCI and the completion of their tasks in 6 months time, it will be too late. Even then there is no guarantee that action will be taken to correct and rectify the grave injustice done to Sabah and the legitimate Sabahans, particularly the natives of Sabah, whether they are KDMs, Bajaus, Suluks, Ubian, Iranun, Kedayan, Bisaya, Rungus, Sungei, Lun Bawang, Sino-natives, Chinese, Indian, Pakistani and the many others.

Therefore, we the ordinary Sabahans must unite and kick out this illegitimate Umno/BN government. There is simply no choice for us unless we want to allow them to continue and destroy Sabah and allow illegal immigrants to continue to be given citizenships and even in cases of non-citizens, the right to vote and decide our future and our destiny.

We owe it to our children and their children to take action right now to correct the injustices done to us in Sabah or regret for the rest of our lives.

Whilst we respect the RCI and the arduous task that it is undertaking, we wish to reply to the opinions of our past and present Prime Minister as well as one of our previous Chief Minister.

Whoever is the Chief Minister of Sabah, he must take every action to safeguard the interests of Sabah and Sabahans. We regret the view of one of our past Chief Minister who, by his own admission, has failed in his duty in protecting Sabah, when he nonchalantly stated that it was the prerogative of the federal government to grant citizenship.

STAR Sabah stands by its view that Sabah is a nation by itself and an equal partner in Malaysia. No doubt that the granting of federal citizenship is within the powers of the federal government, citizenship of Sabah comes under the purview of the Sabah Chief Minister and Sabah government. Every Sabahan citizen is a federal citizen but every federal citizen is not necessarily a Sabah citizen. That is why when West Malaysians enter Sabah and Sarawak, they are subject to immigration rules and they are not allowed to work without a legitimate work permit or to reside in Sabah beyond 3 months without approval.

At the same time, the federal government cannot and should not grant federal citizenships or the right to vote to every Tom, Dick and Harry, who is a muslim. We should only award citizenships to qualified people who can contribute to the country.

In granting citizenships, it is by way of operation of law or by naturalization. Granting of citizenships to children of citizens is by way of law. Giving MyKads based on fraudulent declaration of place of birth in Sabah is not naturalization. It is fraud.

Yet, one of our past Prime Minister is defending the granting of citizenships based on fraud. Our Prime Minister may be right in saying that giving of citizenships is not wrong if it is done according to law. At the same time, he is merely saying what the law says. He should add that giving of citizenships not according to law is wrong and that the perpetuators should be punished.

Comparing citizenships during the formation of the Federation of Malaya in 1957 and in Sabah is totally out of point and out of order.

Firstly, in 1957, it was agreed that citizenships of Malaya be granted to residents in Malaya by application and to children of federal Malaya citizens. This was provided in the Federation of Malaya constitution. In any instance, this situation is no longer applicable when the Federation of Malaya formed the Federation of Malaysia in 1963 with Sabah, Sarawak and Singapore. Secondly, comparing citizenship of Malaya with citizenship of Malaysia is wrong and out of context as it involves 2 different countries and is not an apple-to-apple comparison. Malaya is not Malaysia.

Thirdly, citizenship for Sabahans in Malaysia is clearly set out in the recommendation of paragraph 148(k) of the Cobbold Commission and Point 10 of the 20-Points. The fraudulent issuance of blue ICs and MyKads to the foreigners as disclosed in the RCI hearings are not in accordance with the Cobbold Commission recommendations and Point 10 or even the Federal Constitution.

The problem in Sabah is not just federal citizenships but the abuse and misuse of voting rights given to dubious voters and foreigners as voters-for-hire at RM20 per head.

As a result of these dubious voters and voters-for-hire, we hear of at least 2 cases of Umno candidates, including a former Chief Minister, winning in the 1994 elections, defeating PBS candidates.

“I am not defending PBS here but it is a fact and this should be PBS’ story and their silence clearly shows why PBS and other BN components can no longer be relied to defend Sabah’s rights” added Jeffrey.

We, Sabahans should not allow foreigners and illegal voters to take-away our political franchise and we should not allow Umno/BN to use these dubious voters to remain in power. Their objective is evil and purely for political reasons and to continue to control and colonize Sabah and take-away Sabah’s wealth and oil and gas resources.

At the same time, genuine Sabahans are deprived of their MyKads and citizenships and deprived from exercising their right to vote. In the interiors, native Sabahans have to travel sometimes hundreds of kilometres to apply and then return again to collect their MyKads. This is not the case for the foreigners who have their MyKads hand-delivered to them personally and who are given houses, perks, allowances, subsidies, even loans for their businesses while the natives often get nothing or mere zinc sheets and “tangki 1-Malaysia”.

To add to these dubious and foreign voters, the federal government has planted hundreds, even thousands of their security forces as local voters. In Petagas, Putatan, Bugaya, Semporna, Karambunai, Sepanggar, Sebatik, Kalabakan, these security forces voters determine the outcome of the elections, not the local voters. In Sg. Sibuga, Karamunting and several other constituencies, they number several hundreds and account for up to 5% or more of the voters and influence the outcome of the elections.

STAR Sabah will propose and pass the necessary laws to make only Sabahans vote in Sabah constituencies so that Sabah’s future is decided by Sabahans.

The security forces and non-Sabahans will be allowed to cast their votes in Sabah but they will be sent back to their home constituencies for counting. In any event and in many instances, these security forces have failed to live up to their expectations to protect Sabah and many Sabahans are living in fear due to the rising crime and illegals roaming all over Sabah.

The shocking revelations at the RCI can only mean one conclusion, that is, PROJECT IC EXISTS AND THAT SABAH IS A BIG MESS AND SCREWED UP BY UMNO/MALAYA AND MALAYSIA AND SABAH NEEDS TO BE SAVED. The Malaysia today is not the Malaysia that our forefathers wished or wanted.

We cannot trust the present government to resolve the problems that have been created. Therefore, tough and drastic steps need to be taken. STAR Sabah propose the following be implemented:-

(1) Resignation of the present government;

(2) An INTERIM NON-PARTISAN CARETAKER GOVERNMENT comprising ALL LOCAL POLITICAL PARTIES be formed to govern Sabah;

(3) immediate re-activation of the INTER-GOVERNMENTAL COMMITTEE (IGC);

(4) immediate review of the MALAYSIA AGREEMENT 1963 and related documents;

(5) Establish an independent non-partisan SABAH ELECTORAL REVIEW COMMITTEE to clean up the Electoral Rolls as the current electoral rolls has already been proven to be tainted and the Election Commission cannot be trusted to clean up the same;

(6) Exempt Sabah and Sarawak from the coming PRU-13 until the Sabah Electoral Rolls are totally cleaned up and free from dubious, illegitimate and foreigner voters as there can be no fair and free elections with the current electoral rolls;

(7) Immediate withdrawal of Umno and all Malayan political parties from Sabah;

(8) New elections be held to elect a new Sabah government;

(9) There be new negotiations for the terms for the formation of Malaysia comprising Malaya, Sabah and Sarawak as equal partners;

(10) All Sabahans must unite to take back control of SABAH TANAH AIRKU;

(11) All local component parties of Sabah BN should withdraw from BN and form a local alliance or join the UNITED BORNEO ALLIANCE (UBA) to fight for and safeguard Sabah’s interests and rights in Malaysia.

The coming PRU-13 can be for Malaya/West Malaysia to determine the federal government of Malaya that will be formed after PRU-13 and that will work with the governments of Sabah and Sarawak to form the federal government of Malaysia;

At the same time, we appeal to all Sabahans across the political divide to come together and make a united stand to support STAR Sabah and its alliance partners including USNO to vote out the evil Umno/BN government and to take back our beloved Sabah before it is too late.

We cannot allow illegitimate voters and foreigners to vote and determine the future of Sabah. The future of Sabah lies in the hands of us Sabahans, not outsiders or Sabahans under the control of outsiders.

“ITS NOW OR NEVER, SELAMATKAN SABAH TANAH AIRKU”

Datuk Dr. Jeffrey Kitingan

Chairman of STAR Sabah
