Mahkamah Persekutuan hari ini mengekalkan hukuman setahun penjara ke atas bekas menteri besar Selangor Dr Khir Toyo selepas menolak rayuannya berhubung sabitan kes rasuah minggu lalu.

Mahkamah itu juga menolak tawaran doktor gigi berusia 50 tahun itu untuk melakukan khidmat masyarakat dengan menawarkan rawatan pergigian percuma kepada orang miskin sebagai ganti kepada hukuman penjara.

"Dalam analisis akhir, hukuman itu sepatutnya mencerminkan keseriusan kesalahan itu," kata Hakim Besar Malaya Tan Sri Zulkefli Ahmad Makinudin.

Hakim Zulkefli berkata peguam Khir Tan Sri Muhammad Shafee Abdullah telah berhujah bahawa hukuman penjara perlu menjadi pilihan terakhir kerana anak guamnya merupakan pesalah kali pertama dan tiada keganasan terlibat.

Katanya, apa yang penting adalah kepentingan awam dan ia (hukuman itu) tidak boleh diubah jika ia tidak menyalahi undang-undang.

Hakim Zulkefli berkata khidmat masyarakat adalah tidak mencukupi kerana ia adalah untuk pesalah muda dan kesalahan ringan.

"Khidmat masyarakat tidak terpakai. Tindakannya (Khir) telah menyebabkan gangguan keyakinan terhadap penjawat awam," katanya. [Baca berita penuh]

Sementara itu, Bernama melaporkan Dr Mohamad Khir dihantar ke penjara Kajang.

Pada 22 September, panel itu menolak rayuan akhir Dr Mohamad Khir dan mengekalkan sabitan terhadap pertuduhan memperoleh untuk diri dan isterinya, Zahrah Kechik, dua lot tanah dan sebuah banglo di Seksyen 7, Shah Alam, daripada Ditamas Sdn Bhd melalui pengarahnya, Datuk Shamsuddin Hayroni.

Hartanah itu dibeli pada harga RM3.5 juta sedangkan Ditamas membayar RM6.5 juta untuk hartanah itu pada 23 Dis 2004.

Bekas ADUN Sungai Panjang itu didakwa melakukan kesalahan itu di kediaman rasmi menteri besar Selangor di Jalan Permata 7/1, Seksyen 7, Shah Alam, pada 29 Mei 2007.

Dr Mohamad Khir, yang merupakan menteri besar dari Ogos 2000 hingga Februari 2008, didakwa mengikut Seksyen 165 Kanun Keseksaan yang memperuntukkan hukuman maksimum penjara dua tahun atau denda atau kedua-duanya.

Dr Mohamad Khir, 50, yang berada dalam keadaan berdiri dalam kandang tertuduh, kelihatan tenang semasa mahkamah menjatuhkan hukuman itu.

Mahkamah penuh sesak dengan anggota keluarga, orang ramai dan wakil media. Isteri beliau Zahrah, 50, turut hadir.

Hakim lain yang bersidang dalam panel itu ialah Hakim Tan Sri Ahmad Maarop, Hakim Tan Sri Hasan Lah, Hakim Tan Sri Jeffrey Tan Kok Wha dan Hakim Datuk Ramly Ali.

Dr Mohamad Khir, bapa enam anak, merayu terhadap keputusan Mahkamah Tinggi yang mendapatinya bersalah dan menjatuhi hukuman penjara 12 bulan atas pertuduhan menggunakan kuasanya untuk memperoleh tanah dan sebuah banglo di Shah Alam pada 2007.

Mahkamah Persekutuan turut mengekalkan perintah Mahkamah Tinggi supaya hartanah terbabit dilucuthak dan diserahkan kepada kerajaan.

Doktor gigi itu membawa kesnya ke Mahkamah Persekutuan selepas Mahkamah Rayuan menolak rayuannya pada 30 Mei 2013.

Dr Mohamad Khir diwakili peguam Tan Sri Muhammad Shafee Abdullah manakala Timbalan Pendakwa Raya Idham Abdul Ghani mewakili pihak pendakwa raya.

Mahkamah Persekutuan mengekalkan sabitan rasuah bekas menteri besar Selangor Dr Mohamad Khir Toyo.

"Kami menolak rayuan," kata Hakim Besar Malaya Tan Sri Zulkefli Makinudin selepas Hakim Jeffrey Tan Kok Wha membaca penghakiman.

Hakim Zulkefli mengetuai panel lima anggota hakim.

Mereka termasuk Hakim Mahkamah Persekutuan Tan Sri Ahmad Ma'arop, Hasan Lah, Tan Sri Jeffrey Tan Kok Wha dan Datuk Ramly Ali.

Sebelum ini, Khir didapati bersalah dan dijatuhi hukuman penjara 12 bulan.

Beliau mempunyai rumah agam gaya Bali di Seksyen 7 Shah Alam yang dirampas oleh pihak berkuasa apabila Mahkamah Tinggi mendapati beliau bersalah kerana rasuah.

Mahkamah Rayuan mengekalkan keputusan itu.

Mohamad Khir diwakili oleh Tan Sri Muhammad Shafee Abdullah, M Athimulan, Kamarul Hisham Kamaruddin, Jahabardeen Yunus, Sarah Abishegam.

Pendakwaan diketuai Timbalan Pendakwa Raya Mohd Masri Daud dan Mohd Dusuki Ahmad

Sementara itu, Bernama melaporkan mengikut keputusan yang dibacakan oleh Hakim Tan, mahkamah memutuskan bahawa pertuduhan terhadap Dr Mohamad Khir tidak mempunyai kecacatan.

Beliau berkata tiada kesilapan dalam fakta-fakta pertuduhan yang menyatakan bahawa Dr Mohamad Khir melakukan kesalahan itu atas sifatnya sebagai penjawat awam (Menteri Besar).

Dr Mohamad Khir, 50, yang memakai sut berwarna kelabu, kelihatan tenang apabila mahkamah mengekalkan sabitan dan hukuman penjara setahun.

Mahkamah Persekutuan bersidang hari ini untuk membuat keputusan selepas menangguhkan prosiding pada 27 Ogos lepas kerana Dr Mohamad Khir menjalani rawatan di Institut Jantung Negara (IJN).

Mahkamah Tinggi Shah Alam mendapati Dr Mohamad Khir bersalah kerana mendapatkan untuk dirinya dan isterinya, Zahrah Kechik, 50, dua lot tanah dan sebuah banglo di seksyen 7, Shah Alam, daripada Ditamas Sdn Bhd melalui pengarahnya, Datuk Shamsuddin Hayroni.

Dr Mohamad Khir gagal dalam rayuannya di Mahkamah Rayuan pada 30 Mei, 2013.

Bekas anggota dewan undangan negeri Sungai Panjang itu dituduh melakukan kesalahan tersebut di kediaman rasmi Menteri Besar Selangor di Jalan Permata 7/1, Seksyen 7, Shah Alam, pada 29 Mei, 2007.

Datuk Seri Najib Tun Razak menegaskan beliau tidak akan tunduk kepada mana-mana tekanan yang mahukan beliau meletak jawatan sebagai Perdana Menteri dan Presiden UMNO.

Beliau berkata selagi rakyat menyokong beliau untuk menerajui kepimpinan negara sebagai perdana menteri dan anggota UMNO terus teguh menyokongnya sebagai presiden parti maka beliau tidak akan berganjak daripada jawatan yang disandangnya sekarang.

"Saya cuma tunduk kepada (desakan) ahli parti dan rakyat sahaja. Selagi ahli parti sokong saya, selagi rakyat memberi kepercayaan, saya akan tetap meneruskan perjuangan saya," katanya ketika berucap di hadapan kira-kira 40,000 orang yang hadir pada program Solidariti Rakyat Sabah bersama Perdana Menteri Datuk Seri Najib Tun Razak di Padang Perbandaran Tawau di sini, Ahad.

Penegasan Najib itu yang dinyatakan dengan suara lantang 

mendapat tepukan dan sorakan daripada hadirin yang membanjiri Padang Perbandaran Tawau sehingga melimpah ke kawasan jalan raya, disertai paluan gendang.Beliau menegaskan jawatannya sebagai Perdana Menteri dan Presiden UMNO diperolehinya secara proses demokrasi dan ditentukan oleh rakyat dan anggota UMNO dari seluruh negara iaitu dari Padang Besar di Perlis hingga ke Pulau Sebatik, di Tawau, Sabah.

Ini merupakan kali pertama Najib menjawab secara terbuka dan lantang desakan bekas Perdana Menteri Tun Dr Mahathir Mohamad agar beliau meletak jawatan sebagai perdana menteri dan presiden UMNO.

Najib yang ingin mendengar sendiri suara sokongan hadirin dengan melaungkan "rakyat Sabah sokong" sebanyak tiga kali telah disambut dengan sorakan gemuruh hadirin, "Najib, Najib, Najib".

Menegaskan pendirian kukuhnya, Perdana Menteri sempat membacakan falsafah Bugis yang berbunyi 'Kendati tergantung awan di langit. Telah terlanjur ku bentang layar. Walau badai datang menggunung. Walau berdentum guruh di langit, walau bumi berkeping dua, tak kan mungkin ku berbalik haluan'.

Justeru, kata Najib takkan satu suara lebih besar daripada suara yang didengarnya daripada hadirin dan juga rakyat di Kota Belud ketika menghadiri program perasmian Projek Perumahan Rakyat di daerah berkenaan pagi tadi serta suara rakyat yang telah memberi mandat kepadanya untuk memerintah negara.

Katanya setiap pemimpin termasuk beliau pernah menempuh ujian dan tidak terkecuali Dr Mahathir yang menghadapi lebih banyak ujian ketika menerajui pucuk pimpinan negara selama 22 tahun.

"Mana tak ada ujian. Ujian Team A, Team B (dalam pemilihan UMNO, Dr Mahathir) hampir kalah. Hampir 50 peratus ahli UMNO suruh dia letak jawatan. Tapi apa dia jawab, 'walaupun saya menang satu undi, saya akan tetap terus menjadi Perdana Menteri'. Oh hebat dia jawab.

"1987, saya antara yang menyokong dia. Dia (Dr Mahathir) kekal menjadi Perdana Menteri sebab apa? Sebab kita bersama dalam susah. Bila dalam susah kita beri sokongan dia kekal. Kalau kita sokong pemimpin menghadapi ujian, Dr Mahathir tidak boleh kekal 22 tahun menjadi Perdana Menteri," yang sekali lagi mendapat sorakan hadirin.

"Jadi, janganlah lupa, waktu dia (Dr Mahathir) jadi Perdana Menteri, kita sokong dia penuh. Sekarang dia tidak jadi perdana menteri, sokonglah pula. Kalau tak boleh sokong, janganlah bunyi sangat. Tapi tak apa, jangan rosakkan parti. Kita boleh terangkan (isu berkaitan 1Malaysia Development Berhad - 1MDB)," katanya.

Najib berkata kenyataan Dr Mahathir berhubung 1MDB kebelakangan ini berbelit-belit, sekejap kata 1MDB hilang RM42 bilion selepas itu kata pula tak hilang tetapi 1MDB berhutang RM42 bilion.

Beliau menegaskan kerajaan ada cara tersendiri untuk menyelesaikan isu 1MDB jika diberi tempoh.

Perdana Menteri menjelaskan ketika Tabung Haji membeli sekeping tanah milik 1MDB ia adalah pelaburan dan bukannya 'bailout' 1MDB kerana Tabung Haji boleh memperoleh keuntungan sehingga lebih RM170 juta melalui pembelian itu namun disebabkan perkara itu dijadikan isu, beliau menasihatkan Tabung Haji menjual tanah berkenaan.


Najib berkata melalui penjualan semula aset berkenaan, Tabung Haji boleh untung sehingga RM5 juta hingga RM6 juta namun pada masa sama merugikan pendeposit Tabung Haji sendiri kerana jika aset itu tetap milik Tabung Haji, pendeposit boleh untung sehingga RM170 juta.

"Tetapi kerana isu sudah dipusing sebagai isu yang panas, orang kata 'you are shooting yourself at your foot', tembak kaki sendiri. Inilah yang saya kata tidak rasional.

"Kita buat sesuatu untuk apa? Untuk kebaikan rakyat. Bagilah peluang. Setiap perkara boleh kita selesaikan. Tetapi beri peluang kepada pemimpin untuk menyelesaikan perkara itu," katanya.

Perdana Menteri berkata selepas menyaksikan sokongan padu diberikan rakyat kepadanya seperti yang dapat dilihat pada perhimpunan hari ini, beliau berazam untuk meneruskan perjuangan malah semangatnya kian berkobar.

Turut hadir pada program itu ialah isteri Najib, Datin Seri Rosmah Mansor, Ketua Menteri Sabah Datuk Seri Musa Aman, dua Timbalan Ketua Menteri Sabah Datuk Seri Yahya Hussin dan Tan Sri Joseph Pairin Kitingan, Menteri Belia dan Sukan Sabah yang juga Ketua UMNO Bahagian Tawau Datuk Tawfiq Abu Bakar Titingan dan Anggota Parlimen Kalabakan Datuk Seri Abdul Ghapur Salleh.
